A CHEF who claimed he quit because it was too hot in the kitchen has lost his constructive and unfair dismissal claim.
Adriano Amato took Ristorante Gennaro Ltd to an employment tribunal seeking compensation for his unfair dismissal.

Mr Amato, of Meadowpark Terrace, Edinburgh told a tribunal in the city that he was forced to quit as he was required to work in a kitchen which was too hot and had inadequate ventilation.

Mr Amato advised employer Gennaro Veneruso in August last year that he was leaving to take up other employment, but he subsequently claimed part of the reason was that the kitchen did not meet legal heat tolerance levels set by the environmental health department.

He also complained he had been given a formal warning after he was off sick suffering from stress caused by working conditions.

In its written judgement, the tribunal said there was no evidence of excessive heating of the kitchen and concluded he did not resign because of a fundamental breach in his contract of employment.

correct me if Im wrong but strangely enough I believe there is no legal maximum heat limit.
There is a limit for being too cold but not too hot , which is odd.
We found that working at the new RIE , the heat levels are phenomenal in the summer but nothing legally can be done about it. Even tho patients visitors and staff were farting!!!!!!
