HEARTS replaced one midfielder with another over the weekend as Ugandan international David Obua arrived in place of Fernando Screpis, who has been deemed surplus to requirements by the club.
Screpis' Hearts career is over after just five first-team appearances and, as such, the midfielder appeared on trial for Plymouth Argyle on Friday evening – but he will still pursue a pay-off for the three remaining years on his Hearts contract.

The Argentine has been told he has no future at Tynecastle and did not travel with the squad to their German training base in Wiesbaden last night, but Screpis maintains his current £1500-a-week contract runs until 2011 and that he should be paid in full.

He told the Evening News: "Hearts are telling me my contract is cancelled.

"According to the contract I signed last July I have three years left, so I am waiting for the club to contact me about this.

"I am sad to leave but I don't think I was given enough chances in the team. I don't think I was treated fairly. Anatoli Korobochka treated me well but some others at the club did not.

"I find it strange that the new manager only saw me play for less than 40 minutes but then I am told there is no place for me."

In a meeting with sport director Anatoli Korobochka last week, Screpis was informed he would play no part in the German tour or the forthcoming domestic campaign.

The 29-year-old played five times in the SPL last season after arriving from FBK Kaunas in January. He began fearing for his future after reporting back to Riccarton for pre-season last month and subsequently learned that his original deal could be re-negotiated. Agent Juan Cobian attempted to persuade officials of both Hearts and Ukio Bankas Investment Group, the club's parent company, to retain the midfielder, but to no avail.

Anthony Basso and Calum Elliot were the other notable absentees from the 24-man party which arrived in Germany. The goalkeeper appears to have fallen completely from favour whilst Elliot is keen to settle his future, with Inverness one of several clubs interested in brokering a loan agreement with Hearts.

Obua was scheduled to fly in to Germany today to join his new colleagues, although Robbie Neilson, Mirsad Beslija and Bruno Aguiar have remained in Edinburgh due to fitness problems. Teenagers Matej Rapnik, Ryan McGowan, Gary Glen and David Templeton travelled with the squad.

Subject to a successful work permit application, 24-year-old Obua will become new manager Csaba Laszlo's first new recruit. The Evening News website revealed on Friday that the player was in Edinburgh for talks with Hearts and the club confirmed his prospective signing yesterday.

Obua is comfortable at left midfield but can also operate centrally or in defence.

Meanwhile, Uganda's Under-20 coach, Jackson Mayanja, is in discussions with Hearts over the possibility of becoming Laszlo's assistant.

There are more duds to be moved on, and it remains to be seen whether or not this lad is better.

Well if he is so concerned about being under contract, no doubt Hearts will be entitled to a fee from Plymouth if his trial is succesful?

This would cover any costs, or would Hearts waive the fee for a quick cost fee release?

Interesting. Screpis complained about not being told whats going on when he joined Kaunas and went to the papers. Now he does it again. Likes his name in lights this boy, don't he?
If his contract doesn't have any sort of clause to cancel it then, yeah, if he doesn't want to leave, Hearts have to pay up his contract. Who knows whats actually happening here though, has his contract been cancelled? Has he been told he's getting sold? I guess he'll keep us all informed as it progresses...

Seemed like a half decent player, but we have plenty midfielders already, so if getting rid of him opens up some cash for a decent striker or two it seems like a good move.

Neither do i, if you read the story it says the contract could be negotiated this summer. Whether that means termination should an agreement not be made i don't know. Like you i'm not privy to the legal clauses of the contract between screpis and hearts.

#43 It's not that unusual to have points where a contract can be renegotiated, and - yeah - there'll be some sort of remedy if the two parties can't agree. We don't know what that is, so it's all speculation. It's a shame that Screpis and Hearts can't just keep this internal - we do seem to still have a habit of not talking to people, hopefully that'll change once the new man gets properly settled in. But everyone seems to get paid eventually, so just another distraction from the main thing I reckon.

When a full permit is not issued (which it cannot be due to Uganda not being rated high enough)the matter is then sent to the country's FA for a committee to decide if the specific player will benefit the league he is to join.

That means a three or five man committee made up usually of ex players and present managers to serve as a non biased group that votes on the issue - should the player be allowed into Scottish football .These "fair minded" people have recently so far sat on varied players entering the game here a number of times , but dis-allowing permits only thrice. TWICE BEING PROSPECTIVE HEARTS PLAYERS.(including one player that went on to get the man of the match award against Scotland when Belarus played at Hampden)
Does anyone really think that an SFA/SPL/Weegie driven committee will allow us to benefit from any kind of benevolence from them whatsoever ???????????????????

I know theres a rankings thing as well, but doesn't a percentage of International caps apply then? Im sure ther was an incident where we were looking at a player but decided not to go for him as his percentage of caps would not have been enough. Or to have played so many times for his country out of so many games they played in a period of time.

For the 75% of internationals in last 2 years rule to be in force, the national team in question must have been (on average) in the top 70 ranking teams. Uganda have never got that high so that's where the problem lies.

It doesn't mean it kills the deal tho, this guy's played in the MLS and for SA's biggest team so an appeal may well have a positive result.

A) A player has to have played 75% of internationals in the last two years if his non EU country are outside the top 70 rankings.

or

B) A player can move to us from a non EU country as long as he is an internationalist but if the team he is an internationalist with are outside the top 70 then he must have played 75% of their games in the last two years.

Two very different scenarios really.

#67 I think the rule is that he has to have played in at least 75% of the matches AND the team is in the top 70. At which point the work permit is a formality, beyond that I seem to remember it coming down to individual consideration as to whether the player will benefit the club/league etc.
IIRC Mourinho did a full powerpoint presentation to the tribunal when he was signing Essien...

I'm not an expert on contract law, I'll admit that, but I certainly wouldn't say it's been breached if I didn't know what clauses it contained.
I am impressed tommytommy, I've dealt with a number of lawyers in my time, and they've all insisted on reading contracts before making a decision about whats in them. I'll have to use you in future, all that money wasted on lawyers time when you can make a definitive judgement in 5 minutes without seeing the documentation.
