Cyclist fined after three hours in cell over lights mix-up

A UNIVERSITY lecturer spent three hours locked in a police cell after being stopped for cycling without proper bike lights.
Nicholas Cimini was approached by police as he made the short journey from his flat in Dalry to Brougham Place.

Officers told the 30-year-old they had spotted him cycling along the busy Tollcross Street without any lights on.

But Mr Cimini challenged this, claiming he had left his flat with both lights working and was in the process of locking his bike up when he was stopped by the police.

During the stand-off with police, Mr Cimini shone his front light in one officer's face to prove it was working and it was at this point that it emerged the light had begun to fade because it was low on battery power.

Mr Cimini, who teaches sociology at Napier University, was then arrested for not providing his name or address to the officers, despite repeated requests from them.

He was handcuffed and taken to St Leonard's police station, where he was held in a cell on his own for three hours before being released. The incident took place at 6pm last Wednesday.

Police chiefs today confirmed that Mr Cimini left St Leonard's with a £30 fixed penalty notice for failure to display any lights on his pedal cycle.

Mr Cimini today said he was still shocked and angry over the incident. He said: "It was quite a short trip from my house to my mate's flat and I'd checked the lights before I set off.

"I reached my destination, took the lights off and was locking it up when I saw this officer shouting at me from across the road.

"He came over and said I had been cycling without lights, which I challenged, and shone the light in his face to prove it. This was when I noticed it had dimmed slightly. We then had a discussion about it and during this he slapped the handcuffs on me and I was put in the back of the van, before being taken to the cells.

"I was really shocked. The policeman just wouldn't listen and it was humiliating to be handcuffed and led into the van like some sort of vagrant just for apparently not having my cycle lights working.

"You couldn't imagine a car driver getting the same treatment for not having their lights working, you would have thought the police would have better things to do with their time."

A police spokesman said: "The individual concerned was stopped by police for failure to display any lights on his pedal cycle – an offence under the Road Traffic Act – and was subsequently arrested and detained after refusing to provide either his name or address to officers.

"He was afterwards issued with a fixed penalty notice in respect of the original offence."

Not complying with the law then getting himself lifted for being an numpty... imagine if the police did nothing about this, allowed him to cycle on without lights and he got skelped by a LRT number 14 and killed...

But, seriously, we all make mistakes!!!

Hopefully, Nicholas Cimini will get over his embarrassment - its a bit ruthless for the EEN to publish this given the guy's job and the measlieness of the infringment.

Hope the sub-editor doesn't get caught peeing in a close after his or her xmas night out - he or she might be next for the headlines - if the EEN are so desperate for a story they might even turn on their own?

This article reminds me of my friends experience in South Africa many years ago
He was arrested for murdering his wife and thrown into a shared cell with a coloured South African gentleman
My friend struck up conversation with the South African and confessed to killing his wife to which the South African declared my friend was probably looking at 15 years in jail!
My friend enquired as to the South Africans crime to which the reply was - Oh I got done for riding my bike without any lights on - probably get 10 years
My friend replied - 10 years that's a bit harsh for only riding your bike without lights
To which the South African replied - it would have been 20 years had I been caught at night !!!!

Car drivers would have been treated exactly the same if they were driving with faulty lights, and refused to give details when stopped.

Bottom line: he's a numpty, and he deserved to get nicked.

i'm a cyclist, a pedestrian and a motorist and just can't beleive the draconian attitudes and penalties forced upon cyclists...

last week there was a woman trapped under a bus, a man tossed off into the canal ( both cyclists ) i struggle to fathom where the widespread hostility for cyclists comes from... there are no provisions made for cylists and with impending billion pound tram system on the way to the second fattest nation in the world it looks like the citizens of edinburgh are set to become poorer, stupider and fatter

a small amount of investment in provisions for cyclists would ease these hostilities, congestion and bulging bellies.........so c'mon fatties get on your bikes and put the cake down! how long before one of you knob jockeys pulls me off on my grammer? :)

Good. As a cyclist, I'm fed up being tarred with the same brush as the red-light-jumping, pavement-cycling, no-lights-in-the-dark brigade. If someone gets done for it, good on the police. On the other hand, I hope they're stopping the vast numbers of vehicles I see on the road ever day with only one functioning headlight or rear light...

In this case, the guy was nicked for not having lights. Hardly caused by society not providing cycling facilities...it was caused by some numpty not checking his lights were working. Clearly, that is his responsibility.

Well done to the police, and more of it if you please. This guy is obviously a numpty who would be the first to complain if a bus or car had not seen him and knocked him of his defective bike. Lets remember the lights on his bike (when they are working) are so that other traffic and pedestrians can see the fool, not the other way round. In his well educated job he should be setting an example and surely its not too hard to know what your name and address is, maybe his bosses should be having a word!!

What about the the cycle boxes at the traffic lights? The cycle lanes we motorists pay road tax for?

You even have traffic lights with cyclist signs on them alongside the wee green man.

Oh, and there's the shiny red STOP traffic lights that many (admittedly not all) cyclists insist on going through who then gesticulate rudely at you when they are in the wrong.

I am glad crime is down so much that there is room in St Leonards cells for the unlucky cyclist. No doubt the other empty cells will soon be full of motorists who have been similary humiliated. Perhaps the man who overtook me at speed then turned immediatly left at a junction in Leith might be the first.

Right or Wrong the cyclist may be. However, I would love to know who the senior officer was who gave the order to make a scapegoat of a cyclist and then leak it to the Evening News as a deterrant. Which page of the rule book is that?

No doubt the many, irrationally angry emails above also demonstrates yet again that humilation is part of most peoples early lives. It is sad that such abuse be perpetuated in these columns.

A clear case of this tube failing the attitude test. If he'd put his hands up, smiled and accepted a ticking off the cops would have probably left it at that. Instead, he gets all smart-ar5ed, shining lights in faces and no doubt asking the officers if they didn't have anything better to do or whether they shouldn't be out catching murderers. Then he refuses to provide his name and address, leaving the officers no option but to arrest him. Three hours later he gets out, clutching the same fixed penalty he'd have been given at the time if he'd given his details then. Now he runs to the EEN to bleat about his treatment and some sap journalist, rather than asking him why he didn't give his name, spins the story to make it look like he's the innocent party. As can be seen from the reaction of most posters, no sympathy for this idiot.

Given that the cyclist is happily pictured at the top of the article, one suspects that the Polis were not the source of this particular leak...

To me, looks more like the numpty concerned went to the EEN, thinking he could portray himself as the "victim" of a great police conspiracy. Rather than a numpty who thinks he is above basic rules of road safety, which is closer to the reality.

I'm having trouble seeing in the article any evidence that the police leaked anything. What appears to have happened is the guy's gone whinging to the EEN who have then contacted the police to confirm the story, which they've done. No leaks there, probably quite routine.

I was actually stationary, at my destination, when the police approached me. They cuffed me as I was trying to find out my rights and protest my innocence. I was not purposively being cheeky or withholding information.

It shocks me that the city promotes environmentally friendly transport policies (and cycling as a method of keeping fit), when, at the same time, cyclists are treated as second class road-users.

I must say it would have been nice if these officers (or L&B in general) had arrested some of the many pavement cyclists now infecting Edinburgh.

Is it not the case that the police are now suuposed to be taking more severe action against 'illegal' cyclists, be it lights on bikes, cycling on pavements or going through traffic lights. They don't appear to be doing much about any of it.

this business of 'cuffing' is aslo a complete nonsense where no violence is being offered and can only go to making an already unpopular 'service' even more so.

If this man had been knocked over by a motor vehicle whose driver failed to see him because the cyclists lights weren't bright enough, he'd be the first one to to point the finger at the driver as the cause of the crash.

FAR too many cyclists think they have a god given right to go wherever they want on the roads, to ignore virtually EVERY traffic signal and sign and generally make a nuisance of themselves to other road users (and pedestrians).

There is a very small minority of cyclists who do obey the rules, dress properly in day-glow clothing, signal correctly and respect the traffic around them.

Sadly, it's people like the chap in the article who give this law-abiding minority a very bad name..

My understanding of the law is that having accepted the "conditional offer" of a Fixedd Penalty £30 ticket rather than not, Mr. Cimini also accepted that he was guilty.
I think #34 has it right, he should have just taken a telling off and walked his bike home. Sounds like he acted like a fool and got exactly what he deserved. Mind you, perhaps we need expert legal advice from Gorgie_Tony .... where are you, or are you not cover shift in the news room, eh?

but there are just as many bad motorists on the road, doing the same thing every day.

Its just that bad driving habits have become acceptable.

No 98 read the article, and you'll see why HE GOT HIMSELF into bother.

Like any road user, he could have got a ticking off and been asked to get the defect sorted.

Instead he pointed the light at the officers face and failed to give his name & address.

Should all road users take his attitude, imagine the Police time wasted, if all road users took this prats attitude

Instead he wasted Police time, rather than taking a ticking off he made a right "my initials of it".

Another cyclist who thinks he can do what he likes on the road. He doesn't pay vehicle excise duty for the up keep of the road, he is not forced to pay insurance, he is not forced to display a registration plate - yet expects everything for free. This low life piece of scum was arrested for failing to disclose his particulars. Another cyclist who thinks he can do what he likes has been brought down to earth with a sudden bump. Well done the police for reminding cyclists that they are not above the law. Cyclists take note next time you cycle through that red light - or decide to leave the road and cycle on the pavement - I have said many of time - the council provide them with cycle paths off the road - yet they still insist on cycling on the roads and the pavements. Take the cycle tracks off them (they never paid for them or used them) - and teach them a proper lesson.

BIKE ZERO Emissions ZERO VED

He is a lecturer and presumably a taxpayer, so his taxes go towards road and footpath maintenance.

And his taxes go towards free bus travel for OAPs and the Disabled.

The law does not require registration plates for bikes, but yes its something that needs changing


Take the cycle tracks off them (they never paid for them or used them) - hold on this is paid by the TAXPAYER.....

#103 - as a cyclist, I do pay VED a the same rate as those zero-rated emission cars, ie £0.00. A wee, light bike isn't damaging the roads like a few tons of car, bus or lorry. VED doesn't pay for the upkeep of the roads anyway, use Google and find this out for yourself.

As a cyclist, I have every right to be on the road. After all, I pay VED, insurance etc on my car anyway so I'm already contributing. I'm also insured as a cyclist through the CTC, as well as on my household insurance.

Where precisely do you think off-road cycle paths go ? Do they go everywhere that roads go ? How can I get onto the start of one without cycling on the road to get to where it starts ? Would you like me to cycle on the pavement ? Perhaps you should engage that brain of yours before you put fingers to keyboard and sound any more like 'Mrs Brady - Old Lady' from Viz than you already do.

The only point I'll agree with you on is that cyclists who break the law should expect to be punished, just as all road users who break the law should be.

I havent read all the cooments but this is a clear case of innaccurate reporting .

This man was taken to the cells for NOT GIVING HIS NAME AND DETAILS TO THE POLICE and by doing this acting like a clever git which only serves to make him look like a t1t.

He was NOT taken to the cells for having poor lights.

By the way to the cyclist who cycled the back roads of musselburgh at 6:30 this morning , I sincerely hope you are still alive , it was pitch black and your lights were non existent ,,,,,stupid stupid man.
